Mediation
Mediation is a confidential process which allows families to come to a resolution at their own pace. It is a flexible approach and provides a safe space for families to discuss, negotiate and settle on family issues. It can be more cost effective and a process to help avoid a costly and public litigation process.
Collaborative Law
Collaborative practice is a no-court approach to separation and divorce, where parties commit to reaching settlements out-of-court. From a legal perspective, the collaborative approach allows you to settle your case on your own time. Lawyers work together to help families resolve their issues without the threat of court. You can settle the terms of your family law matter without the stresses of highly contentious court hearings. This process also allows your family law matter to remain private and your personal details will not become public information.
Litigation
If a family law issue cannot be resolved through agreements or mediation, we can assist with commencing and proceeding with litigation in Court. Despite commencing a court action, we can continue to negotiate a settlement or in the alternative, proceed with Trial.
Agreements
If you are getting married or planning to live with a spouse, you may want to consider a cohabitation agreement or marriage agreement. These agreements are often referred to as prenuptial agreements. It is an effective way for families to explore different family issues and to help protect family assets.
If you are separated or divorced, you may want to consider a separation agreement to agree on family issues such as property division and debts, child and spousal support, parenting arrangements and any other family issues.
Family Law Consultation
The Illuma team are experienced trial lawyers, however going to court is not always the best solution. We will consult with you on the best approach for legal matters addressing co-habitation agreements, prenuptial agreements and marriage agreements. For couples looking to separate, we consult on divorce, spousal support, division of assets & debts. For those with children, we are experts on parenting arrangements and child support.
Adoption Services
If you are a step-parent, or other adoptive parent, looking to adopt a child, you must apply through the BC Supreme Court. The Illuma team can help you with the court documents required to apply and finalize adoption. In addition, we help with disputes relating to parental rights and adoption. We provide consultation and representation in court.
